MASTER TERMS AND CONDITIONS OF SERVICE

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING, USING, OR ENGAGING WITH SAHIB GARAGE’S WEBSITE, DIGITAL TOOLS, WORKSHOP, REPAIR, MAINTENANCE, OR RESTORATION SERVICES.

1. PREAMBLE, JURISDICTION, AND BINDING CONTRACT

1.1. This document constitutes a legally binding electronic agreement between you (hereinafter referred to as the “Customer”, “User”, or “Vehicle Owner”) and Sahib Garage (hereinafter referred to as the “Garage”, “Service Provider”, “We”, “Us”, or “Our”), operating its primary physical workshop and facilities out of Bhopal, Madhya Pradesh, India.

, submitting your vehicle details online, utilizing digital diagnostic assistants (including Sahib AI), requesting doorstep pickup services, or handing over physical custody of your motor vehicle to our technicians, you unconditionally acknowledge, accept, and agree to be bound by every clause, condition, and limitation outlined herein.

1.3. Governing Law and Jurisdiction: These Terms and Conditions, alongside any service contracts entered into, shall be strictly governed by, construed, and enforced in accordance with the laws of the Republic of India. Any disputes, claims, controversies, or legal proceedings arising directly or indirectly out of services rendered, product installations, or website usage shall be subject exclusively to the appropriate courts, consumer forums, and judicial authorities located within Bhopal, Madhya Pradesh, to the explicit exclusion of all other courts and territorial jurisdictions across India or globally.

2. SCOPE OF AUTOMOTIVE SERVICES

Sahib Garage provides specialized, multi-brand automotive care, which is broadly classified into three distinct service verticals:

  • Mechanical Operations: Comprehensive internal combustion engine overhauling, fluid flushes, transmission maintenance, suspension tuning, brake system restoration, steering repairs, and routine periodic maintenance schedules.
  • Electrical & Electronic Systems: Wiring harness repairs, alternator and starter motor servicing, battery diagnostics, electronic control module (ECM/ECU) scanning, sensor replacements, lighting fixtures, and in-car accessory integration.
  • Denting, Painting & Aesthetic Restoration: Panel beating, accidental chassis realignment, dent removal, multi-layer scratch remediation, localized paint touch-ups, primer applications, and comprehensive full-body vehicle color restorations.

3. STRICT ABSOLUTE DISCLAIMER ON ELECTRICAL PARTS AND COMPONENTS

3.1. NO WARRANTY OR GUARANTEE ON ELECTRICAL SPARES: In absolute conformity with global automotive manufacturing guidelines, standard original equipment manufacturer (OEM) policies, and aftermarket supplier practices, there is strictly NO guarantee, warranty, replacement undertaking, or refund policy applicable to any electrical parts, electronic modules, sensors, bulbs, wiring circuits, microchips, ECUs, entertainment units, or batteries procured and installed by Sahib Garage.

3.2. Inherent Vulnerability Clause: Modern automotive electrical architecture is exceptionally sensitive to external and internal environmental variables, including voltage fluctuations, short-circuits caused by aging wiring, water ingress, pre-existing localized power drains, and battery failures. Because these factors lie entirely outside the control of Sahib Garage technicians once the vehicle leaves the workshop premises, all electrical replacements, electronic repairs, and related installations are performed strictly on a “No-Warranty, Final-Sale” basis. The customer explicitly waives any right to claim financial damages, replacement parts, or free labor for any subsequent or sudden failure of electrical components.

4. DENTING, PAINTING, AND FULL-BODY RESTORATION WARRANTY TERMS

4.1. 2-Year Limited Restoration Warranty: Sahib Garage provides a conditional, limited 2-year warranty exclusively on full-body restoration and comprehensive multi-layer paint jobs executed at our workshop, subject strictly to the compliance parameters outlined in this section.

4.2. Mandatory 6-Month Periodic Inspection Rule: To maintain the validity and continuity of the 2-year paint and body restoration warranty, the customer is legally and operationally mandated to bring the vehicle physically to the Sahib Garage workshop in Bhopal every six (6) months from the date of initial invoice delivery for a mandatory structural and surface inspection.

4.3. Rectification Protocol: If our certified technicians discover minor environmental fading, surface bubbling, lacquer peeling, or workshop-attributable paint defects during these mandatory 6-month checkups, Sahib Garage will inspect and rectify the specific fault.

4.4. Absolute Warranty Termination: Failure by the customer to produce and present the vehicle at our workshop within the precise 6-month windows (allowing zero grace periods past the completion date of every half-year term) shall result in the immediate, permanent, and irrevocable voiding of the entire 2-year restoration warranty, releasing Sahib Garage from any further remedial obligations whatsoever.

5. DASHBOARD WARNING LIGHTS & POST-HANDOVER POLICY

5.1. Post-Delivery Indicator Disclaimer: Any warning indicators, Check Engine lights, ABS warnings, airbag alerts, transmission faults, or electronic notification symbols that illuminate on the vehicle’s instrument cluster dashboard after the vehicle has been fully serviced, inspected, approved, and handed over to the customer shall NOT be linked, attributed, or connected to any preceding repair work conducted by Sahib Garage.

5.2. Modern motor vehicles operate via highly complex, multiplexed computer networks where components are interconnected. Unless a specific warning light is directly, explicitly, and unequivocally tied to a mechanical part or component replaced under a current, paid repair order (verified and reported in writing within exactly forty-eight [48] hours of physical delivery), any newly surfacing dashboard warning light shall be treated as an independent mechanical or electronic event. Such instances require a completely fresh diagnostic assessment and an independent, chargeable repair estimate.

6. PRE-EXISTING FAULTS, UNRELATED DEFECTS, AND LIMITATION OF LIABILITY

6.1. Exclusion of Collateral Faults: Sahib Garage assumes liability strictly and exclusively for the specific, itemized, invoiced, and paid repair services explicitly authorized by the customer.

6.2. If any latent, hidden, underlying, or pre-existing mechanical, structural, or electrical defect manifests, breaks down, or is uncovered during or after the service cycle—which is unrelated to the specific operational scope of work executed within our workshop—Sahib Garage shall bear zero liability, financial responsibility, or legal accountability for such unrelated faults.

6.3. Maximum Liability Cap: Under no circumstances whatsoever shall Sahib Garage’s cumulative, total legal and financial liability to the customer for any disputed service, delayed repair, or alleged damage exceed the actual net labor charges paid by the customer for that specific, individual job card invoice.

7. COMPLETE LEGAL WAIVER AND RESTRICTION OF LITIGATION

7.1. Waiver of Consumer and Legal Actions: By handing over physical possession of your vehicle, signing a job card, making digital bookings, or utilizing our website, the customer explicitly covenants and agrees that if any guideline, instruction, maintenance schedule (including the mandatory 6-month checkup), payment term, or operational limitation set forth in these Terms and Conditions is violated, breached, or ignored by the customer, the customer, their heirs, assigns, or legal representatives shall forfeit all rights to initiate, file, or pursue any legal action, consumer forum complaints, civil lawsuits, or criminal proceedings against Sahib Garage, its proprietors, mechanics, agents, or corporate successors.

7.2. Any attempt to file frivolous litigation or claims in contravention of this explicit waiver shall be countered by Sahib Garage seeking full legal cost recovery, compensation for business interruption, and damages for defamation in the courts of Bhopal, Madhya Pradesh.

8. VEHICLE STORAGE, UNCLAIMED PROPERTY, AND FORCE MAJEURE

8.1. Unclaimed Vehicles: Vehicles left parked at the Sahib Garage workshop facility for more than seven (7) consecutive days following formal telephonic or digital notification of service completion will attract standard, cumulative daily parking and space occupancy fees, which must be cleared in full prior to vehicle release.

8.2. Force Majeure: Sahib Garage shall not be held liable for any failure, delay, or impediment in fulfilling vehicle repairs or deliveries caused by events beyond our reasonable control, including but not limited to acts of God, extreme weather events, civil unrest, government restrictions, nationwide transport strikes, severe parts procurement supply-chain bottlenecks, or third-party logistic failures.

9. MODIFICATION OF TERMS

Sahib Garage reserves the absolute right to alter, amend, update, add to, or completely revise these Terms and Conditions at any time without prior individual or direct notification. The latest updated version will be posted directly on Sahib Garage
